Durham Roller Skating Inc. Risk Waiver & Acceptance form 2025 The following assumptions of risk, consents, waivers and releases of liability, form part of a LEGALLY BINDING DOCUMENT. Please READ CAREFULLY before signing. DO NOT SIGN IF UNSURE of the content and consequences. ACKNOWLEDGMENT OF RISK, PARTICIPANT WAIVER, RELEASE OF LIABILITY, COVENANT NOT TO SUE & IMAGE RELEASE In consideration of the acceptance of this entry in or upon the Durham Roller Skating Inc. facility, and/or my/our participation in any way in Durham Roller Skating Inc. recreation, spectating, training, competition(s), race(s), related events, workshops and/or activities (together known as the "Events"), I/we, the undersigned, acknowledge, covenant and agree that: WARNING AND ASSUMPTION OF RISK/VOLUNTARY COMPLIANCE 1. I/WE UNDERSTAND THAT THE ABOVE-MENTIONED EVENTS/WORKSHOPS/LESSONS ARE INHERENTLY RISKY, physically demanding, and that participation in same EVENTS MAY RESULT IN SERIOUS INJURY and/or FATALITY. a. SERIOUS INJURY and/or FATALITY from the above-mentioned Events includes, but is not limited to: (i) sprains; (ii) strains; (iii) fractures; (iv) collisions with objects or barriers that are a part of the premises such as fences, poles and stands (v) concussion/head trauma (vi) physical and emotional distress, (vii) injuries involving mechanical devices or equipment (viii) accidents involving, but not limited to skating, dancing, running, jumping, sliding and falling ;(ix) heart attack, (x) brain damage, (xi) exhaustion and/or dehydration, and (xii) the potential for permanent paralysis and/or death. b. Contact with participants, sports equipment, or other persons; and other contact that may lead to serious bodily injury, including but not limited to concussions and/or other brain injury or serious spinal injury, negligent advice regarding the Activities c. While rules, equipment, and personal discipline may reduce this risk, the risk of Serious Injury or Death continues to exist; 2. EPILEPSY WARNING: Some individuals with photosensitive epilepsy may experience seizures When exposed to certain patterns or flashing lights. Exposure to certain light patterns may induce epileptic seizure in these individuals, and certain conditions may induce undetected epileptic symptoms even in persons who have no prior history of seizures or epilepsy. If you, or anyone in your family, has an epileptic condition please consult your medical practitioner before participating. 3. SAFETY EQUIPMENTS I/We acknowledge that while not absolutely required for participation in the above Events, wearing a helmet is strongly recommended. Additionally, wrist guards, knee pads and other sport specific protective gear is highly recommended while engaging in the Activities by Durham Roller Skating Inc. to reduce the chances of injury. I/We acknowledge that I/We are responsible for any/all equipment deemed necessary by Me/Us based on My/Our individual understanding of personal ability and skill level. I/We agree to personally supply any/all equipment deemed necessary to participate safely in the above Events and guarantee that any/all equipment supplied is properly fit and in good working order. Additionally, I/We guarantee that I/We are familiar with the proper use of the equipment and its maintenance. I/We agree that the use of any/all protective equipment is at our own discretion and accept any risk resulting in the decline of its use. 4. I/WE AM/ARE SATISFIED THAT I/WE HAVE FULLY INFORMED MYSELF/OURSELVES ABOUT THE EVENTS THAT I/WE WILL OR MAY BE PARTICIPATING IN AT ALL EVENTS FACILITATED BY DURHAM ROLLER SKATING INC. AND I/WE KNOWINGLY AND FREELY ASSUME AND ACCEPT ALL RESPONSIBILITY AND RISKS, BOTH KNOWN AND UNKNOWN, for my/our participation in the Event. • 5. I/WE VOLUNTARILY AGREE TO COMPLY with the stated and customary terms, verbal instructions/directions, and conditions for participation. If, however, I/we observe any unusual and/or significant hazard and/or malfunctioning of equipment during my/our presence or participation, I/we will remove myself/ourselves from participation and bring such hazard to the attention of the nearest employee, official, agent, or volunteer of DURHAM ROLLER SKATING INC. ; 6. I/WE VOLUNTARILY AGREE TO REPORT any accidents, injuries, loss or damage you suffer during the EVENTS no matter how minor the injury may appear at the time it occurs to an authorised representative on the day such an occurs or is known. You agree to assist us in preparation of an incident report in respect of such an incident and will provide all documents requested of you required to complete this report. You consent to receiving any medical treatment that the EVENTS organisers or their authorised representatives consider necessary or desirable during or after the EVENTS 7. I/WE ACKNOWLEDGE THAT DURHAM ROLLER SKATING INC. MAY, at its own discretion, REVOKE THE PARTICIPANT'S PRIVILEGES to attend at the premises of a DURHAM ROLLER SKATING INC. EVENT, to use DURHAM ROLLER SKATING INC. and equipment and to participate in the programs and activities offered by DURHAM ROLLER SKATING INC. . WAIVER & RELEASE OF LIABILITY 8. I/we, for myself/ourselves and on behalf of my/our heirs, executors, administrators assigns, personal representatives and/or next of kin, voluntarily and forever WAIVE, RELEASE, DISCHARGE and COVENANT NOT TO SUE DURHAM ROLLER SKATING INC. and their officers, directors, representatives, officials, principals, agents and/or employees, subsidiaries, and/or incorporators, as well as their independent contractors, sponsoring agencies, sponsors, advertisers, volunteers, and if applicable, owners and lessors of the premises used to conduct the Event (collectively, the "Releasees"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, and/or loss or damage to person or property, that may be incurred by me/us in connection with participation in the aforementioned Events. a. Without limiting the generality of the foregoing, THIS RELEASE SHALL APPLY TO ANY LIABILITY, CLAIM, ACTION, SUIT OR DAMAGE CAUSED BY THE NEGLIGENCE OF, DURHAM ROLLER SKATING INC. the condition of the equipment or the premises or the actions of third parties. b. I/we further agree to indemnify, defend, and hold harmless Releasees from any loss, liability, cost, claim or damages arising from my/our participation in or association with Events organized and sponsored by DURHAM ROLLER SKATING INC. or connected with the Events. • 9. I/WE ATTEST AND VERIFY THAT I/we a.am over 18 years of age, b. am free from all illnesses, injuries and defects that could interfere with my/our safe participation in any of the above Events, c. that I/we am physically fit and sufficiently trained to participate in all activities associated with the Events, and d. I/We mental condition is appropriate to participate in the events and I/We assumes all risks related to the Participant's mental and physical condition to comply with the rules and regulations for participation in the Activities e. that the information given on this form is correct and complete. 10. DRUGS AND ALCOHOL: I/WE ATTEST AND VERIFY THAT I/we agree not to use alcohol, tobacco, illegal drugs, or prescription drugs that have not been prescribed by a medical doctor to treat a current medical condition, during the EVENT, prior to the Event, while on the property DURHAM ROLLER SKATING INC. IS UTILIZING FOR ANY EVENT,AT ANY TIME or at any time that may affect my ability to participate in the event. I understand that drugs and/or alcohol may impair my ability to participate in the above EVENTS and will remain sober and free of these substances during the full duration of my stay and until departing the EVENT property. Additionally, I will not engage in any unlawful acts at such events, including but not limited to the unlawful or unauthorized use, possession, distribution or consumption of alcoholic beverages or illegal/banned drugs at said events. I/we consent to removal, barred entry and/or immediate suspension of all participation at the sole discretion of any employee, official, or agent, of DURHAM ROLLER SKATING INC. without compensation, refund or reward upon discovery or suspicion of the consumption of these substances. • 11. MY/OUR PARTICIPATION IN THE EVENTS organized or sponsored by DURHAM ROLLER SKATING INC. IS ENTIRELY VOLUNTARY. CONSENT TO FIRST AID and/or MEDICAL TREATMENT 12. I/WE CONSENT TO administration of first aid and other medical treatment in the event of injury or illness and hereby release and indemnify Releasees from any and all liability or claims arising out of such treatment. • WARNING AND ASSUMPTION OF RISK, IMAGE AND LIKENESS 13. I/we understand that there are inherent risks associated with publication of my/our photograph, audio and image of personal likeness on the Internet, in videos and in publications. These risks may include but not be limited to identity theft and wrongful assumption by others of my/our identity or who I/we is/are and or danger to myself/us. I/we agree to assume these risks, whether known or unknown to me/us of permitting publication of my/our photograph, image of personal likeness and or personal audio on the Internet, in publications or in videos. GRANT OF PERMISSION, IMAGE AND LIKENESS 14. I/we irrevocably grant unlimited permission to Releasees, to use, reproduce, sell and distribute any and all photographs, images, videotapes, motion pictures, recordings, or any other depiction of any kind of me/us or of my/our participation in the Event or related activity for any legitimate purpose in perpetuity and I/we understand that I/we shall not be entitled to any compensation therefore. RELEASE, IMAGE AND LIKENESS 15. I/we hereby irrevocably and absolutely grant permission to the Releasees to film, videotape and record gratis the performance of the above named participant (referred to herein as "I", "I/we", "me", "me/us", "my", "my/our") in the aforementioned Events and subsequently to telecast, sell, distribute and otherwise utilize the same in whatever manner Releasees shall deem appropriate. Such permission shall include granting the unlimited and irrevocable right to Releasees, without compensation of any kind to me/us, to use, reproduce or broadcast, my/our name, nickname, image, likeness, voice, photograph, signature facsimile, and biographical information in connection with the Event without compensation of any kind to me. I/we acknowledge that Releasees and their representatives shall have the unlimited right throughout the world to copyright, use, reuse, publish, republish, broadcast and otherwise distribute depictions of or information about me and all or any portion of the Event in which I/we may appear on any and all radio, network, cable and local television programs and in any print materials and in any other format or media (including electronic media) now known or hereinafter devised in perpetuity and without compensation to me. In consideration and in return for being allowed to participate in the Events, I/we release and agree not to sue the Releasees from all present and future claims regarding my/our participation in the Events that may be made by me/us, my/our family, estate heirs, or assigns. GENERAL 16. I/we agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect. I/WE HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I/WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. I/WE CONFIRM THAT I/WE HAVE HAD AN OPPORTUNITY TO OBTAIN LEGAL ADVICE BEFORE SIGNING THIS ACKNOWLEDGEMENT AND WAIVER AND HAVE CHOSEN NOT TO DO SO. The provision of false information or signature releases said parties from any and all liabilities, loss, cost claim, or damage whatsoever.
